Introduction

Yes — in principle, a routine scheduling note could have been prepared by James S. Lay Jr. while Robert Cutler was absent and still have been associated administratively with Cutler’s office. But the stronger claim — that it would therefore be normal for such a note to carry only Cutler’s typed name, with no indication that Lay or another subordinate issued it — is not established by the surviving procedural evidence.

That distinction is central to the alleged Cutler–Twining MJ-12 memorandum of 14 July 1954. Its text is essentially logistical: an alleged briefing is moved into an already scheduled White House meeting, Twining is told to alter his plans, and details are deferred until his arrival. Supporters therefore characterise it as exactly the sort of small administrative matter Lay could have handled while Cutler was overseas. Stanton Friedman explicitly made that argument. Yet authentic National Security Council material shows Lay routinely putting his own name and title on communications he transmitted, including highly classified ones. Why supporters call the Twining message routine

The alleged memorandum’s operative content is unusually modest compared with the extraordinary subject line, “NSC/MJ-12 Special Studies Project”. It does not purport to establish a committee, report intelligence findings or give Twining substantive policy instructions. Instead, it says that a briefing should occur during an already scheduled White House meeting on 16 July rather than afterwards, that more precise arrangements will be supplied on arrival, and that Twining should alter his plans accordingly. That administrative character is the strongest part of Friedman’s Lay hypothesis. Cutler was indisputably away: the National Archives records that he was visiting military installations in Europe and North Africa between 3 and 15 July. More importantly, the Archives found a 3 July memorandum in which Cutler instructed James Lay and J. Patrick Coyne on handling NSC administrative matters during his absence. Friedman pushed the point further. He argued that Lay, as Executive Secretary of the NSC, was well placed to send a quick notification on Cutler’s behalf and cited Cutler’s instruction to keep work moving. He also reported that George Elsey, an Eisenhower-era White House official, regarded a brief Lay-to-Twining scheduling communication on Cutler’s behalf as entirely plausible. There is also independent evidence that Lay was in direct contact with Eisenhower on 14 July. The President’s official appointment book records Lay and Deputy Executive Secretary S. Everett Gleason meeting Eisenhower off the record that afternoon to brief him on NSC affairs. This does not corroborate an MJ-12 discussion — the entry says nothing of the sort — but it does establish the mundane institutional premise behind Friedman’s argument: Lay was at the White House performing NSC business for the President on the very day in question.[Eisenhower Presidential Library]eisenhowerlibrary.govEisenhower Presidential Library

So the delegation theory clears an important but limited hurdle. A scheduling change did not require Cutler to be physically in Washington merely because his office normally dealt with the recipient. Lay had the position, access and delegated responsibility needed to keep NSC administration functioning.

Could Lay legitimately leave Cutler’s name on it?

This is where the question becomes more difficult. “Lay could have handled the matter” and “Lay could normally issue the resulting memorandum solely under Cutler’s typed name” are different propositions.

Authentic NSC documents show that Lay was not an invisible clerical intermediary. He issued memoranda explicitly as Executive Secretary and put “James S. Lay, Jr.” at the bottom. A Top Secret memorandum of 18 May 1954 concerning contingency studies for possible US intervention in Indochina is a particularly useful comparison. Lay conveyed that “The President has authorized” requests for highly secret studies and then issued detailed instructions to the State Department. The same pattern appears in more ordinary transmission work. A Top Secret memorandum of 12 January 1954 transmitted Joint Chiefs of Staff views to the National Security Council for an upcoming meeting and was attributed to “James S. Lay, Jr.” A Secret memorandum of 2 March transmitted a revised financial appendix for another forthcoming Council meeting and likewise carried Lay’s name. Nor did sensitivity change that convention in an obvious way. On 29 March 1954 Lay circulated a Top Secret special annex on Indochina with instructions for exceptionally restricted handling. Again, the surviving official record identifies it as a memorandum by Lay in his capacity as Executive Secretary. The most pointed comparison is a separate memorandum dated 14 July itself. Contemporary discussion of the MJ-12 controversy drew attention to a declassified NSC memorandum concerning the Aircraft Nuclear Propulsion Program, addressed to the Secretary of Defense and the chairman of the Atomic Energy Commission. That communication conveyed a presidential decision and was issued under James S. This does not prove that every note Lay prepared had to carry his name. Government correspondence practices can vary with document type, office practice, intended recipient and whether an official is drafting, transmitting, signing for somebody else or merely preparing a carbon for the files. But it weakens any argument that Lay’s administrative role itself explains the Cutler attribution. Authentic parallels show that Lay could act for the NSC, communicate presidential decisions and conduct sensitive business without masquerading textually as Cutler.

The unsigned form cuts both ways

The absence of a signature remains the most interesting feature for the delegation hypothesis. Friedman emphasised that the alleged Cutler–Twining memorandum has neither Cutler’s handwritten signature nor an “/s/” indication that an original had been signed. As an internal-consistency argument, this has some force. An unsigned office copy is easier to reconcile with preparation by a subordinate than a document carrying a demonstrably impossible Cutler signature would have been. The lack of a signature therefore means that Cutler’s absence is not, on its own, a decisive mechanical disproof: somebody in Washington could have typed a short communication associated with his office.

But an unsigned memorandum is not the same thing as evidence that Lay authored it. Nor does the absence of a false signature establish authenticity. A document can be unsigned for many reasons, and anyone constructing a document could omit a signature. The evidential question is narrower: can authentic Cutler–Lay records demonstrate a recognised practice in which Lay prepared outgoing scheduling memoranda during Cutler’s absence, left only Cutler’s typed name and title at the bottom, and supplied no “for”, “by direction of”, initials, signature notation or other indication of delegated authorship?

The National Archives’ investigators effectively answered that question in the negative on the evidence available to them. Their 1987 reference report acknowledged the 3 July delegation instructions but reasoned that, had the Twining memorandum been genuine, one would expect Lay or Coyne to have signed it. That judgement is especially significant because it does not deny delegation. What an authentic procedural parallel would need to show

The issue therefore cannot be settled simply by producing more evidence that Lay worked closely with Cutler. That relationship is already well supported. Nor is it enough to show that Lay was authorised to process NSC affairs or met Eisenhower on 14 July. The missing evidence is a much more specific documentary parallel.

An especially persuasive comparison would be an unquestioned Eisenhower-era memorandum satisfying most of four conditions: Cutler was absent or otherwise unavailable; Lay or Coyne demonstrably prepared or dispatched the communication; the subject was a routine change of meeting or briefing arrangements; and the finished memorandum nevertheless carried Cutler’s typed name alone, without the subordinate’s signature or another indication of acting authority.

A series of such examples would be stronger still. It could establish that the disputed form reflected a recurring office convention rather than an ad hoc explanation created after Cutler’s travel became known. Conversely, if surviving files consistently show Lay signing his own outgoing memoranda — including short scheduling notices and communications issued while covering Cutler’s responsibilities — the procedural objection becomes considerably stronger.

One relevant authentic pattern points towards visible authorship. Lay’s surviving NSC memoranda repeatedly identify him as the transmitting official, from straightforward circulation notices to Top Secret instructions. The evidential burden is therefore quite precise. Supporters do not need to prove that a subordinate could ever draft something for a superior; that is unremarkable office practice. They need a close historical analogue showing that this particular NSC office treated a short outgoing memorandum in the way the Lay explanation requires.

The scheduling argument solves only half the problem

Classifying the alleged Cutler–Twining memorandum as a routine scheduling note makes the James Lay explanation more plausible at the level of workflow. Cutler had delegated administrative responsibilities, Lay was an established NSC executive rather than a junior clerk, and Eisenhower’s appointment records put Lay in direct NSC business with the President on 14 July. The difficulty lies at the level of documentary form. Authentic records demonstrate that Lay normally had an official identity of his own on NSC correspondence, even when communicating presidential decisions and handling Top Secret matters. The fairest conclusion is therefore narrower than either “Cutler was abroad, so the memorandum is impossible” or “Lay was covering for Cutler, so the attribution is normal”. Cutler’s absence does not eliminate the possibility of a subordinate-generated scheduling note. Delegation provides a credible mechanism for the work to have been done. What remains unproven is the mechanism that matters most for this particular document: why an authentic Lay-generated outgoing memorandum would identify Robert Cutler alone as its apparent sender.

Until a close procedural parallel is produced, the routine nature of the alleged message explains how Cutler’s office might have sent it without Cutler. It does not establish that the surviving document looks the way such delegated correspondence actually should.
