Did the GAO Find Any Official MJ 12 Record?

Introduction

The US General Accounting Office (GAO, now the Government Accountability Office) did not find evidence that the circulated Majestic 12 material was originally created as official executive-branch records. In a two-page letter dated 28 July 1995 to Representative Steven H. Schiff of New Mexico, GAO reported that the relevant federal bodies knew MJ-12 chiefly from material supplied by people outside government and had found no corresponding records in their files. That finding is particularly important to the authenticity case surrounding the alleged 1952 Eisenhower briefing. The question GAO addressed was narrower than whether every claim associated with MJ-12 could be disproved: investigators asked whether the purported secret papers could be tied to the documentary systems of the US government. On that question, the answer was negative. Why the GAO examined the MJ-12 material

The MJ-12 inquiry formed a related part of Representative Schiff’s larger effort to determine what federal records existed concerning the 1947 Roswell incident. The principal GAO Roswell investigation examined record-keeping requirements and searched for surviving government documentation; its findings were published on 28 July 1995 as report NSIAD-95-187. This distinction matters. GAO was not conducting a general investigation of UFO beliefs or attempting to determine through scientific evidence whether extraterrestrial craft existed. Its MJ-12 work concerned documentary authenticity and government provenance. The circulated material claimed to represent highly classified government records dealing with UFO recovery procedures and the Roswell crash. By the time GAO examined the question, federal agencies had already been receiving MJ-12 enquiries from members of the public since the late 1980s. The organisations identified by GAO included the Information Security Oversight Office (ISOO), which oversaw executive-branch national-security classification programmes; the Office of the Secretary of the Air Force’s security and investigative apparatus; and the National Archives. GAO also sought the views of archivists at the Harry S. Truman and Dwight D. Eisenhower presidential libraries. What federal agencies told investigators

The most consequential result was strikingly consistent. ISOO, the Air Force and the National Archives told investigators that their knowledge of Majestic 12 was limited to written material that nongovernmental people had submitted to them. They reported finding no records in their own files relating to MJ-12. That finding goes directly to the provenance problem surrounding the Eisenhower Briefing Document. A paper can contain plausible names, dates, classification markings and descriptions of genuine institutions without thereby becoming a government record. What would strengthen its status considerably is an independent official trail: an originating-office copy, registry entry, related correspondence, filing reference, declassification history or corroborating material preserved elsewhere in government. The classification issue was equally significant. According to GAO, ISOO and the Air Force advised that the MJ-12 material should not be treated as though it had actually been classified by an executive-branch agency or government official. GAO then stated that its work had found nothing contradicting those conclusions. The presidential libraries supplied another independent check. Archivists at both the Truman and Eisenhower libraries told GAO that they had received public questions about MJ-12 over the years. The broader National Archives record reinforces why that absence mattered. The Archives says that searches were conducted among Air Force and Joint Chiefs of Staff holdings and through National Security Council indexes from the Truman and Eisenhower administrations. Search terms included “MJ-12”, “majestic”, UFO-related terms and “Aquarius”. The 1980 “MJ Twelve” message failed a direct check

GAO encountered one item that initially looked more promising because it appeared to carry a recognisable government origin. Among material that members of the public had supplied to ISOO in connection with previous Freedom of Information Act requests was a message dated 17 November 1980. Rather than accepting the document’s appearance as proof, GAO asked AFOSI to authenticate it. The response provided a useful illustration of the difference between a paper that looks governmental and one that can be established through government records. There was also a prior authenticity determination. AFOSI reported that it had previously examined the message in connection with an earlier Freedom of Information Act request and had concluded that it was a forgery. The episode is important because it illustrates the method underlying the GAO conclusion. The test was not simply whether a document used an official-looking format or terminology. Investigators checked whether the supposed originating organisation possessed a corresponding official record and asked that organisation about authenticity. In this instance, the answer was negative on both counts.

The archival exception did not establish an MJ-12 programme

There is one complication that can make the federal record seem less straightforward at first sight. The National Archives possesses a one-page memorandum dated 14 July 1954, nominally from presidential adviser Robert Cutler to General Nathan Twining, whose subject line refers to an “NSC/MJ-12 Special Studies Project”. But archival custody is not the same thing as authentication of a document’s origin or contents. The National Archives explicitly explains that when it certifies a reproduction, it is attesting that the copy reproduces a document in its custody; it is not authenticating the document or the information in it. Among them, the memorandum lacks the Top Secret register number expected for the series in which it was found; no other document in its folder concerns “NSC/MJ-12”; searches of related Defence Department, Joint Chiefs, Air Force and National Security Council records produced no supporting material; and the classification marking on the memorandum was reported to be one not used by the NSC until the Nixon administration. There was an additional chronological difficulty. The Eisenhower Library’s records showed that Cutler was visiting military installations in Europe and North Africa from 3 to 15 July 1954, meaning he was overseas on 14 July, the date on which he supposedly issued the memorandum. The Cutler-Twining paper therefore does not overturn GAO’s finding about the circulated MJ-12 material. What the GAO conclusion does and does not establish

For the Eisenhower Briefing Document authenticity case, that is a serious evidential problem. The briefing purports to be an extraordinarily sensitive presidential document. Yet the 1995 congressional investigation did not uncover the institutional traces needed to connect the circulated material to the government whose classification system, officials and authority it invokes.

The conclusion should not, however, be enlarged beyond what GAO actually established. An unsuccessful records search cannot logically demonstrate that no secret programme could ever have existed, nor did GAO claim to prove such a universal negative. Records can be missing, misfiled, destroyed or withheld. But that general possibility does not supply positive evidence for MJ-12. For authentication purposes, the burden runs in the other direction: a purported government document becomes more credible when independent records connect it to the agency, office, classification process and historical chain of custody it claims. The 1995 GAO inquiry found no such corroborating trail for the circulated Majestic 12 papers.

That distinction is the enduring value of the GAO review. It did not settle every conceivable question surrounding UFO secrecy. It addressed a more concrete and answerable one: could investigators establish that the famous MJ-12 material was genuinely produced as US executive-branch documentation?
