Introduction
The strongest documentary evidence says Robert Cutler was not at the White House when the memorandum bearing his name was dated 14 July 1954. Cutler, President Dwight D. Eisenhower’s Special Assistant for National Security Affairs, was on an official inspection trip to military installations in Europe and North Africa from 3 to 15 July. Before leaving, he gave National Security Council staff members James S. Lay and J. Patrick Coyne instructions for handling business during his absence. That fact does not, by itself, prove that the document was forged. An office can issue correspondence in an absent official’s name, and MJ-12 defender Stanton Friedman argued that Lay could have drafted the short notice for Cutler. But this explanation changes the question. Where Robert Cutler Was From 3 to 15 July 1954
Cutler’s absence is not an inference based merely on a missing appointment or an uncertain recollection. According to the National Archives’ MJ-12 reference report, the Eisenhower Presidential Library located a memorandum and report that Cutler sent to the President after returning. Dated 20 July 1954, it described his visits to military installations in Europe and North Africa between 3 and 15 July. That itinerary places Cutler overseas throughout the critical period:
- 3 July: the documented overseas trip began. Before or as he departed, Cutler issued instructions to James S. Lay and J. Patrick Coyne concerning the handling of NSC administrative matters during his absence.
- 14 July: while Cutler was still abroad, the disputed memorandum to General Nathan Twining was supposedly issued under Cutler’s name.
- 15 July: Cutler’s documented inspection period ended. A contemporary roster reproduced in later discussion of the Eisenhower Library findings also does not place him at the regular NSC meeting that day.

The July 3 instructions are especially relevant because they show that Cutler anticipated administrative business continuing without him. The National Archives summarises the document as instructions to Lay and Coyne on how to handle NSC matters while he was away. There is consequently little serious dispute over the basic geographical point. Even Friedman, one of the Cutler-Twining memorandum’s most prominent defenders, accepted that Cutler was outside the United States on 14 July. Why Cutler’s Absence Complicates Direct Authorship
If “from Robert Cutler” is understood to mean that Cutler personally prepared or authorised the memorandum at the White House on 14 July, the travel record creates an obvious difficulty. He was thousands of miles away on an inspection tour. The wording of the disputed sheet makes that problem more interesting rather than less. It is a very short operational instruction. It tells Twining that the President has changed the timing of an “MJ-12 SSP briefing” associated with an already scheduled White House meeting on 16 July and asks him to alter his plans. That absence of a signature supports two sharply different interpretations.
For critics, it removes precisely the evidence that could connect the paper personally to Cutler. The sheet does not establish that he typed it, dictated it, signed it or saw it. His typed name is therefore an attribution rather than proof of authorship. When that attribution is considered alongside the independently documented fact that Cutler was abroad, direct personal authorship becomes difficult to sustain.
For Friedman, however, the lack of a signature was evidence consistent with Cutler’s absence. He argued that an intelligently fabricated Cutler document might have been expected to contain Cutler’s signature or an “/s/” notation indicating a signed original. Instead, the document is unsigned. This is an important distinction. Cutler’s overseas trip is strong evidence against the simplest reading — that Cutler himself sat in Washington and issued the document on 14 July. It is not logically sufficient to establish forgery, because official correspondence can be drafted and dispatched by subordinates.
The real authenticity question is whether there is affirmative evidence that such delegated issuance actually happened in this case.
Could James Lay Have Issued It for Cutler?
Friedman’s alternative-authorship case centres on James S. Lay, the Executive Secretary of the National Security Council. It is not inherently implausible that Lay would have handled Cutler’s work. That later memorandum is useful because it counters an overly strong version of the sceptical argument: Cutler was not necessarily isolated from Washington merely because he was abroad. The document, dated 16 July, discusses NSC business and closes with Lay anticipating Cutler’s return. Contemporary high-level government officials travelling among military installations could also communicate securely with Washington. Friedman added another circumstantial point. He reported finding evidence that Lay met Eisenhower at the White House on the afternoon of 14 July and spoke with the President by telephone later that day. He proposed a straightforward scenario: Eisenhower changed the arrangements for the supposed briefing; Lay, handling Cutler’s office during the trip, then sent Twining a brief scheduling notice in Cutler’s name. That reconstruction demonstrates possibility, but possibility is weaker than provenance. The available material cited by Friedman does not itself say that Eisenhower discussed MJ-12 with Lay, instructed Lay to contact Twining, or authorised the disputed memorandum. Nor does the Cutler-Twining sheet identify Lay as its drafter. This distinction matters because an authenticity argument cannot simply reverse the burden of proof. Evidence that Lay could have prepared the memorandum answers the objection that Cutler’s absence made issuance physically impossible. It does not independently establish that Lay did prepare it.
What Delegated Issuance Can — and Cannot — Explain
Delegated drafting provides a credible administrative mechanism for some of the memorandum’s unusual features. Cutler had explicitly arranged for business to continue while he was away; Lay occupied a senior NSC position; and the disputed message concerns a small change of scheduling rather than a lengthy policy paper. It can also explain why the surviving document lacks Cutler’s personal signature. Friedman went further, arguing that this unsigned state was unexpectedly appropriate to Cutler’s actual whereabouts and therefore difficult to reconcile with a poorly informed hoaxer. But delegated issuance does not resolve the central evidential gaps. No cited contemporary record identifies Lay as the author of the Cutler-Twining memorandum. The National Archives reports no supporting MJ-12 material in the folder containing it and no corroborating information from searches of related Air Force, Joint Chiefs, Secretary of Defense and NSC records. There is also a subtle problem with treating the unsigned format as affirmative authentication. An unsigned document may be compatible with subordinate drafting, but compatibility is not identification. Once Cutler’s absence is known, several explanations remain possible: Lay or Coyne could have prepared a genuine message under delegated authority; Cutler might conceivably have communicated instructions from abroad; an unidentified official could have generated it; or an unofficial creator could have deliberately or accidentally produced an unsigned document. The absence of a signature cannot distinguish among those possibilities on its own.
The same caution applies to Friedman’s argument about what a hypothetical forger knew. The chronology of when modern researchers themselves discovered particular archival facts can be suggestive, but it does not establish what information was available to whoever created the sheet. Without knowing when the document was actually produced or who produced it, an argument about what its creator “could not have known” remains difficult to prove.
Could Cutler Have Issued the Memo While Abroad?
In a broad administrative sense, yes: Cutler’s overseas location did not make it impossible for his office to issue a memorandum carrying his name or authority. His July 3 instructions show that he had delegated the handling of NSC business, and the surviving Lay correspondence indicates that work continued while he travelled. In the narrower sense of personal authorship, however, the evidence points the other way. Cutler was demonstrably overseas from 3 to 15 July. Nothing on the disputed sheet establishes his personal participation, and no corroborating record located by the National Archives identifies Lay, Coyne or another official as the actual drafter. The most defensible assessment lies between two overstatements. Cutler’s trip is not a stand-alone proof of forgery, because delegated White House and NSC correspondence was entirely possible. But neither does the delegation hypothesis neutralise the problem. It replaces a documented contradiction — Cutler was abroad — with an undocumented reconstruction in which Lay supposedly acted for him.
That asymmetry is why the travel evidence remains significant in the Cutler-Twining authenticity dispute. Cutler’s whereabouts are supported by contemporary records preserved in the Eisenhower holdings; Lay’s authorship of the alleged MJ-12 memorandum is a later hypothesis intended to reconcile the document with those whereabouts.
