The strongest contemporary comparison for the claim that James S. Lay Jr. secretly prepared the disputed Cutler-to-Twining memorandum is another National Security Council memorandum dated 14 July 1954 itself. That surviving document concerns the Aircraft Nuclear Propulsion Program. Unlike the alleged MJ-12 memorandum, it identifies Lay openly as the responsible official: James S. Lay Jr., Executive Secretary. This does not prove that Lay could never draft something for Robert Cutler. Cutler was abroad, had left instructions for Lay and J. Patrick Coyne to keep NSC business moving, and Lay was plainly conducting important presidential and NSC business in Washington. The narrower question is whether the evidence supports the additional claim needed to rescue the alleged MJ-12 memo: that Lay would issue such a memorandum under Cutler’s typed identity without identifying himself. Lay’s documented work in Washington on 14 July
James S. Lay Jr. was not a peripheral White House clerk. As Executive Secretary of the National Security Council, he occupied a central administrative position in the machinery that turned presidential and Council decisions into formal communications. Officially published NSC records from the Eisenhower period repeatedly show documents headed as notes or reports by the Executive Secretary and ending with Lay’s own name. That established role matters because Cutler really was absent in mid-July 1954. The National Archives reports that Cutler visited military installations in Europe and North Africa between 3 and 15 July. MJ-12 advocate Stanton Friedman interpreted the same circumstances differently. He argued that the delegation showed Lay had authority to keep Cutler’s work moving, and he later cited evidence that Lay and Cutler worked closely together. There is an important distinction here. Those facts make Lay’s involvement in White House business on 14 July plausible. They do not independently establish that Lay produced the alleged MJ-12 document, nor do they establish a practice of sending memoranda bearing Cutler’s typed name while suppressing Lay’s own authorship. The question is therefore best tested against documents showing what Lay actually did when conducting official business.
The Aircraft Nuclear Propulsion memorandum comparison
The Aircraft Nuclear Propulsion memorandum provides an unusually tight control case because it comes from the same office environment and the same date as the disputed Cutler-Twining paper. According to the surviving declassified document reproduced in Just Cause, it is dated 14 July 1954, comes from the Executive Office of the President’s National Security Council, and is addressed to the Secretary of Defense and the Chairman of the Atomic Energy Commission. Its contents were not trivial office housekeeping. The memorandum communicated a presidential decision concerning an issue before the national-security establishment. It reported that the President had been advised that revisions to the relevant NSC action were not appropriate; that further Council action was unnecessary; that the matter should proceed through regular channels, including budgetary review; and that the Atomic Energy Commission, consulting with the Department of Defense, should prepare an appropriate response to the congressional Joint Committee on Atomic Energy. The subject itself also belonged squarely within established NSC business. Official Foreign Relations of the United States records show that aircraft nuclear propulsion had already been the subject of high-level Council deliberation. That makes the comparison stronger than simply finding an unrelated Lay letter from roughly the same period. Here is Lay communicating presidentially connected national-security business, involving senior defence and atomic-energy officials, on the very day on which the disputed MJ-12 memorandum supposedly emerged from the same governmental apparatus.
The contrast is straightforward:
- In the documented Aircraft Nuclear Propulsion memorandum, Lay’s role is visible and attributable: his name and office identify him as Executive Secretary.
- In the alleged MJ-12 memorandum, the body addresses General Twining but the closing attribution reads “ROBERT CUTLER / Special Assistant to the President”, even though Cutler was overseas. The same-day Lay memorandum therefore supplies something that the general delegation argument lacks: an example of observed administrative behaviour rather than a reconstruction of what Lay might conceivably have done.
Did Lay normally write in Cutler’s name?
The available record supports a careful answer: Lay certainly performed official work while Cutler was absent, but the evidence located here does not demonstrate that he normally issued formal correspondence as though Cutler himself were its author.
That distinction became explicit in the early MJ-12 debate. Just Cause drew attention to the non-UFO Lay memorandum of 14 July and asked why Lay or Coyne would not similarly have taken responsibility for the Cutler-Twining memorandum if one of them had produced it. Its argument was not that delegation was impossible. The broader documentary record is consistent with that observation. The State Department’s official Foreign Relations of the United States series preserves Lay’s Top Secret NSC 149/2 document as a “Report to the National Security Council by the Executive Secretary (Lay)”. After conveying decisions adopted by the Council and approved by Eisenhower, it identifies Lay by name. Friedman’s defence addressed this problem principally through circumstance. He emphasised Cutler’s instructions to keep work moving, the absence of a Cutler signature or “/s/” on the disputed memorandum, Lay’s close working relationship with Cutler, and Lay’s contacts with Eisenhower that day. But that is an inference in several stages. It requires accepting not merely that Lay could draft correspondence, but that he could appropriately produce this particular classified memorandum under Cutler’s name; that the absence of a signature fits that procedure; and that his presidential contacts on 14 July concerned the unverified MJ-12 briefing rather than ordinary NSC business. None of the sources located here supplies a contemporary record connecting Lay’s presidential contacts to MJ-12.
The last point is especially important because Lay had abundant legitimate reasons to deal with Eisenhower. As Executive Secretary he handled real NSC matters at the highest classification levels. His presence in presidential business therefore establishes access and opportunity, not the subject of the interaction. Treating the mere fact of contact as evidence of an MJ-12 instruction risks using Lay’s ordinary job responsibilities to prove the extraordinary proposition under dispute.
What the comparison means for the delegation defence
The July 14 Aircraft Nuclear Propulsion memorandum does not make delegated authorship impossible. Administrative practice is rarely so uniform that a single comparison can establish that an official never used another format. An aide might prepare language for a superior, transmit an instruction orally, or handle correspondence in ways that leave little documentary trace. What the comparison changes is the burden of the argument. The delegation defence begins with a well-supported proposition — Cutler was away and Lay was helping conduct NSC business — but then moves to a much less well-supported one: that Lay therefore probably generated this memorandum under Cutler’s name. That is also why the National Archives’ observation carries more weight than a simple argument that “Cutler could not have written it”. The most defensible conclusion is therefore narrower than either side’s strongest claim. Lay is a plausible person to have handled Cutler’s work on 14 July 1954, but the surviving evidence does not substantiate the specific claim that he authored the Cutler-Twining memorandum in Cutler’s name.
