Introduction

James S. Lay Jr.’s 16 July 1954 message to Robert Cutler is useful because it turns the delegation argument from an abstract possibility into an observable working relationship. Cutler was overseas from 3 to 15 July, and before leaving he had instructed Lay and J. Patrick Coyne to keep National Security Council (NSC) administrative business moving. That makes the document a valuable comparison for the disputed 14 July Cutler–Twining memorandum associated with the alleged MJ-12 papers. It supports the limited proposition that Lay really did act for an absent Cutler and kept him informed. It does not, however, establish that Lay wrote the Cutler–Twining memorandum, still less that an “NSC/MJ-12 Special Studies Project” existed. The most revealing question is therefore not whether delegation occurred, but what surviving delegated work actually looked like.

What the July 16 Lay-to-Cutler memorandum establishes

The strongest point in favour of the delegation explanation is simple: Lay was not merely authorised in theory to cover Cutler’s responsibilities; contemporary material shows him actively doing so.

The National Archives records that Cutler travelled through Europe and North Africa between 3 and 15 July 1954 on presidential instructions. It also identifies a 3 July memorandum in the NSC Staff Papers in which Cutler told Lay and Coyne how to handle administrative matters during his absence. The 16 July document adds the operational side. Stanton Friedman reported obtaining it through mandatory classification review after requesting NSC material at the Eisenhower Library. In his contemporary account, he described it as a classified “Message to General Cutler from Lay”, dated 16 July 1954, summarising matters discussed at the previous day’s NSC meeting. That is significant for a narrow historical reason. Cutler’s physical absence from Washington did not suspend the operation of his office. Lay was receiving information, following NSC business and communicating the state of that business back to his superior. Anyone assessing the Cutler–Twining memorandum therefore has to distinguish two different propositions:

  • Cutler could not personally have typed or dispatched a Washington memorandum on 14 July. His travel makes that a real chronological problem.
  • Nothing associated with Cutler’s responsibilities could have been prepared while he was away. The Lay material makes that much harder to maintain.

The July 16 message is strong evidence against the second proposition, but it leaves the first untouched.

How Lay documented work handled during Cutler’s absence

The July 16 message is especially valuable because it supplies a procedural comparison rather than merely another statement that delegation existed.

Friedman’s description indicates that Lay’s message had a recognisable authorial relationship: it was a communication from Lay to Cutler, reporting on work conducted while Cutler was away. Lay did not disappear behind Cutler’s identity simply because he was covering the office. That matters because the National Archives reached much the same procedural conclusion when examining the Cutler–Twining document. After locating Cutler’s 3 July delegation instructions, archival staff wrote that, if the disputed memorandum were genuine, one would assume “Lay or Coyne would have signed it”. Their point was not that delegation was impossible. The July 16 update therefore sharpens the debate. It demonstrates that Lay’s involvement in Cutler’s workload was real, but it also gives researchers a surviving example in which that involvement was overt rather than concealed beneath Cutler’s name.

There is another useful detail. Friedman’s account says the message reviewed issues discussed at the NSC meeting of 15 July. It shows what “keeping things moving” could mean in practice.

Contemporary government records also confirm that Lay’s position was substantively important. State Department historical material repeatedly identifies the NSC Executive Secretary as part of the senior machinery through which Council papers, meeting actions and follow-up memoranda moved. None of this requires accepting the alleged MJ-12 papers. It simply fixes a historical baseline: Lay was an appropriate official to handle sensitive NSC administration, and during Cutler’s absence he demonstrably communicated about business conducted on Cutler’s behalf.

The comparison with the disputed memo

The July 16 document helps the Cutler–Twining case in one respect and hurts it in another.

For supporters of authenticity, it answers the crude “Cutler was abroad, therefore impossible” objection. Friedman used the message precisely this way. He argued that Cutler had told Lay to keep his in-basket moving, that Lay was in contact with the White House, and that the 16 July communication proved Lay was actively managing matters while Cutler was away. Friedman also connected this hypothesis to presidential contact on 14 July. In his published argument, he stated that Lay met with Eisenhower that afternoon and later had a brief telephone exchange with him. The final step — that Eisenhower told Lay to send the disputed memorandum — is an inference.

The 16 July message therefore establishes capacity and practice, not specific authorship.

That distinction is easy to lose because the two claims sound similar. “Lay was handling Cutler’s work” is well supported. “Lay wrote this particular memorandum in Cutler’s name” requires additional evidence tying Lay to that document. The surviving July 16 update does not provide such a tie.

Where the delegated-authorship comparison breaks down

The strongest reason not to treat the July 16 message as authentication of the Cutler–Twining memorandum is that the two documents answer different administrative needs.

Lay’s July 16 communication was an internal update to his returning superior. Its authorship was explicit. The disputed 14 July memorandum, by contrast, is addressed to General Twining, carries the typed name and title of Robert Cutler and bears no Lay or Coyne signature. Nor does the broader archival record supply the missing link. National Archives staff searched NSC meeting minutes and indices and found no mention of “MJ-12” or “Majestic” in the July 1954 Council records. The wording of the disputed memorandum does refer only to an “already scheduled White House meeting”, rather than explicitly calling it an NSC meeting. There is also a chronology worth keeping precise. What the July 16 memo changes

The best use of Lay’s July 16 message is as a control sample for the delegation question.

Without it, the Lay explanation could be dismissed too easily as an invented mechanism devised after Cutler’s absence became known. The surviving evidence makes that dismissal untenable. But the same comparison raises a more exacting authentication test. Known delegated work leaves Lay visible as an actor. The disputed Cutler–Twining memorandum does not. That does not prove forgery by itself — offices can produce documents in different forms for different purposes — but it means the July 16 message cannot be treated simply as a precedent for anonymous substitution of Lay for Cutler.

The fairest historical conclusion is therefore narrower than either side’s strongest formulation. Lay’s July 16 update shows that delegated authorship and administrative continuity were genuine features of Cutler’s absence. It removes Cutler’s overseas travel as an automatic disproof of any memorandum emerging from his office. At the same time, it provides no documentary evidence that Lay authored the 14 July Cutler–Twining memorandum, and its explicit Lay-to-Cutler authorship gives weight to the National Archives’ question about why Lay or Coyne is absent from the disputed document.

As a test of delegated authorship, the July 16 message strengthens the plausibility of the mechanism while leaving the identity of the author of the alleged MJ-12 memorandum unresolved.
